Court ordered mediation is to solve problems so they are freeing up the court calendar. If there are 10 disputes and mediation solves 7, the court docket has less to solve. Judges don’t like cases, nor do they want to be on the record as that leaves them open to appeal.You will not be allowed to explain yourself to a judge, Pleadings and Motions is what judges get to make YOUR life changing decisions. When judges get to the bench they are to work “For The People” but that isn’t how it works. Most judges are arrogant, and could care ess about your children. assets, or fairness. By design the system is a game of checkers of who “looks'' best, not what is right morally.
I am not certified and I’m not an attorney, I am a mom, granny, business owner, and dog lover. I can only help if both parties agree, mediation comes with a confidentiality agreement, I do require confidentiality. As I am not an attorney I can not waive the rights or obligation of any subpoena. Upon receiving a subpoena I would simply provide the confidentiality agreement.
I’ve had cases in the court system (divorce, probate, and civil), the problem with the system is it does NOT see people. And it doesn’t care how ruling affects people’s lives. By entering into mediation the legal system, your personal and religious beliefs can all come into decisions.
A judge will always order mediation. Attorney Mediation and Certified Mediation charge each side anywhere from $250 to $1,000 per hour.
The judge doesn’t care if the parties sit down together, have coffee with a friend, or pay $500 to $2,000 an hour; AGREEMENT clears their schedule. The last mediation I was ordered to was 7 hours, with an attorney at $240 per hour each side and nothing was resolved. My daughter was charged $1,900 for a simple 50/50 parenting plan. Thus my reasoning to start Common Sense Mediation.

I’m very versed in people hiding assets behind a corporation. It is a common practice and with 21 years as a forensic accountant I know where to look.
I understand about fighting a will.
I know how an agreement on a parenting plan changes as age of kids, job promotions, and income changes.
I’m very comfortable with saying “I don’t understand this complex issue”.
My fees are $25 per person per hour. I start with a list of what each want, what the values are, what they are willing to give up. Usually just sitting down calmly can solve things for most issues.
I have no knowledge about Trust Law, or International Issues. I have no issues looking at those disputes. Contesting a Will is another issue that I have never personally been through, and I can look at the issues.
But no matter the case; AGREEMENT is what mediation is for.
I pride myself in common sense. Any issues I can’t help with can always go to an Attorney or Certified Mediation, or the judge.
